Podjetja v gradbeni\u0161tvu, gostinstvu, proizvodnji, transportu in IKT re\u0161itev vse pogosteje i\u0161\u010dejo zunaj meja Evropske unije. Vendar pa zaposlovanje tujih dr\u017eavljanov ni preprost administrativni korak. Da bi tuji delavec lahko zakonito prestopil mejo in za\u010del z delom, morata tako delodajalec kot zaposleni natan\u010dno poznati, kak\u0161ni so zakonski pogoji.<\/span><\/p><p><span style=\"font-weight: 400;\">Glavni steber te zakonodaje predstavljata Zakon o zaposlovanju tujcev (ZZSDT) in Zakon o tujcih (ZTuj-2). Ta dva zakona natan\u010dno dolo\u010data, kak\u0161ni so pogoji za vstop v Slovenijo, kako se pridobi ustrezno dovoljenje za prebivanje v Sloveniji ter kdaj in za koga je obvezen vizum za Slovenijo.<\/span><\/p><p><span style=\"font-weight: 400;\">Za podjetja je klju\u010dno razumevanje celotnega postopka, saj lahko administrativne napake povzro\u010dijo dolgotrajne zamude, globe s strani In\u0161pektorata RS za delo ali celo prepoved zaposlovanja tujcev. V resnici sta podro\u010dji pravno prepleteni skozi dva klju\u010dna zakona:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db14bf4 elementor-widget elementor-widget-heading\" data-id=\"db14bf4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">1. Zakon o zaposlovanju tujcev (ZZSDT)<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-004e6d5 elementor-widget elementor-widget-text-editor\" data-id=\"004e6d5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Ta zakon ureja pogoje, pod katerimi lahko tujec iz tretjih dr\u017eav (dr\u017eav, ki niso \u010dlanice EU, EGP ali \u0160vice) sploh dostopa do slovenskega trga dela. Dolo\u010da vlogo <span style=\"text-decoration: underline;\"><em><strong><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/agencija-za-zaposlovanje\/\">Zavoda RS za zaposlovanje<\/a><\/strong><\/em><\/span> (ZRSZ), pogoje za izdajo soglasij ter obveznosti delodajalca glede pla\u010dila, delovnega \u010dasa in socialnih prispevkov.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2a7540 elementor-widget elementor-widget-heading\" data-id=\"d2a7540\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2. Zakon o tujcih<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ec4203 elementor-widget elementor-widget-text-editor\" data-id=\"8ec4203\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Ta zakon se osredoto\u010da na migracijski vidik. Ureja zakonitost vstopa, vrste vizumov, pogoje za izdajo dovoljenj za za\u010dasno in <span style=\"text-decoration: underline;\"><em><strong><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/dovoljenje-za-prebivanje\/\">stalno prebivanje<\/a><\/strong><\/em><\/span> ter varnostne zadr\u017eke, zaradi katerih se tujcu vstop v dr\u017eavo lahko zavrne.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0692d20 elementor-widget elementor-widget-text-editor\" data-id=\"0692d20\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Najnovej\u0161e spremembe zakonodaje prina\u0161ajo dodatne poenostavitve za hitrej\u0161i vstop deficitarnih poklicev, hkrati pa uvajajo stro\u017eje varovalke za za\u0161\u010dito delavcev kot je na primer obveznost delodajalca, da tujcu na lastne stro\u0161ke in znotraj delovnega \u010dasa zagotovi minimalno 80 ur te\u010daja slovenskega jezika ob prvi zaposlitvi.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-72c2e57 e-flex e-con-boxed e-con e-parent\" data-id=\"72c2e57\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d39570a elementor-widget elementor-widget-heading\" data-id=\"d39570a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/zavod-za-zaposlovanje-tujci\/\">Zakon o zaposlovanju tujcev in obveznosti za delodajalce<\/a><\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-23b9e7a e-flex e-con-boxed e-con e-parent\" data-id=\"23b9e7a\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2cea948 elementor-widget elementor-widget-text-editor\" data-id=\"2cea948\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Preden sploh za\u010dnete razmi\u0161ljati o zbiranju dokumentacije za bodo\u010dega zaposlenega, morate kot podjetje dokazati, da izpolnjujete zakonske pogoje za <strong><span style=\"text-decoration: underline;\"><em><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/agencija-za-zaposlovanje\/\">zaposlovanje tujih delavcev<\/a><\/em><\/span><\/strong>. Dr\u017eava \u017eeli stem prepre\u010diti ustanavljanje fiktivnih podjetij (&#8220;po\u0161tnih nabiralnikov&#8221;) za veri\u017eenje delovnih dovoljenj.<\/span><\/p><p><span style=\"font-weight: 400;\">Podjetje ali samostojni podjetnik mora izpolnjevati naslednje pogoje:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-a8f93b2 e-flex e-con-boxed e-con e-parent\" data-id=\"a8f93b2\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-d1f6704 e-con-full e-flex e-con e-child\" data-id=\"d1f6704\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-41374ec elementor-widget elementor-widget-heading\" data-id=\"41374ec\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">1. Aktivno poslovanje<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-009a87e elementor-widget elementor-widget-text-editor\" data-id=\"009a87e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Podjetje mora pred vlo\u017eitvijo vloge vsaj 6 mesecev neprekinjeno poslovati in imeti v tem \u010dasu zaposleno vsaj eno osebo za polni delovni \u010das (ali pa mora izkazati investicijo v osnovna sredstva v vi\u0161ini najmanj 50.000 EUR v prvih \u0161estih mesecih po registraciji).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b9a48a3 e-con-full e-flex e-con e-child\" data-id=\"b9a48a3\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-986e3c4 elementor-widget elementor-widget-heading\" data-id=\"986e3c4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2. Poravnane dav\u010dne obveznosti<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2ed35a9 elementor-widget elementor-widget-text-editor\" data-id=\"2ed35a9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Podjetje ne sme imeti neporavnanih dav\u010dnih dolgov (potrdilo FURS o pla\u010danih davkih in prispevkih). Vsi dav\u010dni obra\u010duni morajo biti pravo\u010dasno oddani.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c7d4a22 e-con-full e-flex e-con e-child\" data-id=\"c7d4a22\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-97d96b0 elementor-widget elementor-widget-heading\" data-id=\"97d96b0\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">3. Odsotnost kazni s podro\u010dja delovnega prava<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c695d7f elementor-widget elementor-widget-text-editor\" data-id=\"c695d7f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Delodajalec v zadnjih dveh do petih letih (odvisno od prekr\u0161ka) ne sme imeti pravnomo\u010dnih kazni za prekr\u0161ke, povezane s prepozno izpla\u010danimi pla\u010dami, zaposlovanjem na \u010drno ali kr\u0161itvami pravic delavcev.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-f02bb30 e-con-full e-flex e-con e-child\" data-id=\"f02bb30\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-280ee2c elementor-widget elementor-widget-heading\" data-id=\"280ee2c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">4. Zaposlitev za polni delovni \u010das<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1d1b209 elementor-widget elementor-widget-text-editor\" data-id=\"1d1b209\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Po novih pravilih mora biti <span style=\"text-decoration: underline;\"><em><strong><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/pogodba-o-zaposlitvi\/\">pogodba o zaposlitvi<\/a><\/strong><\/em><\/span> s tujcem sklenjena za polni delovni \u010das (40 ur tedensko), razen v specifi\u010dnih, z zakonom izjemoma dolo\u010denih primerih.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ce56354 e-flex e-con-boxed e-con e-parent\" data-id=\"ce56354\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-a48e964 elementor-widget elementor-widget-heading\" data-id=\"a48e964\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/dovoljenje-za-prebivanje\/\">Kako pridobiti enotno dovoljenje za prebivanje v Sloveniji in soglasje za delo?<\/a><\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-d3409bf e-flex e-con-boxed e-con e-parent\" data-id=\"d3409bf\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-0d5395a elementor-widget elementor-widget-text-editor\" data-id=\"0d5395a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Slovenija uporablja sistem &#8220;vse na enem mestu&#8221;. To pomeni, da se hkrati re\u0161ujeta tako <span style=\"text-decoration: underline;\"><em><strong><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/dovoljenje-za-prebivanje\/\">dovoljenje za prebivanje<\/a><\/strong><\/em><\/span> v Sloveniji kot soglasje za delo. Postopek se spro\u017ei z oddajo vloge za enotno dovoljenje in poteka v naslednjih korakih:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b9ed84f e-con-full e-flex e-con e-child\" data-id=\"b9ed84f\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-adb98a9 elementor-widget elementor-widget-heading\" data-id=\"adb98a9\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">1. Kontrola trga dela (PDM-1)<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b94bda5 elementor-widget elementor-widget-text-editor\" data-id=\"b94bda5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Delodajalec mora najprej na <span style=\"text-decoration: underline;\"><em><strong><a href=\"https:\/\/bcmgroup.in\/sl\/blogi\/zavod-za-zaposlovanje-tujci\/\">Zavod RS za zaposlovanje<\/a><\/strong><\/em><\/span> oddati obrazec PDM-1 (Prijava prostega delovnega mesta).
