Ta dokument ni le gola formalnost, temve\u010d osrednji steber stabilnosti, kobe stranki varuje pred pravnimi zapleti. Ker zakonodaja (ZDR-1) ne dopu\u0161\u010da povr\u0161nosti, mora biti vsaka pogodba napisana premi\u0161ljeno in brez nevarnih lukenj. S podpisom te listine se zaposleni prostovoljno vklju\u010di v ekipo podjetja, kjer svoje naloge opravlja osebno, redno in po navodilih vodstva vse to seveda v zameno za redno mese\u010dno pla\u010dilo.<\/span><\/p><p><span style=\"font-weight: 400;\">Slovenska zakonodaja dela ne dovoljuje poljubno urejati z zunanjimi izvajalci (preko s.p., \u0161tudentskih napotnic ali podjemnih pogodb), \u010de so izpolnjeni spodnji pogoji. Ta zakon deluje kot sistemski predpis, ki \u0161\u010diti \u0161ibkej\u0161o stranko v delovnem razmerju praviloma je to delavec.<\/span><\/p><p><span style=\"font-weight: 400;\">ZDR-1 dolo\u010da minimalne pravice, ki jih delodajalec ne more zaobiti ali zmanj\u0161ati, niti s privolitvijo delavca. \u010ce dolo\u010dilo v pogodbi ponuja manj pravic, kot jih predpisuje zakon ali veljavna kolektivna pogodba, je tak\u0161no dolo\u010dilo neveljavno, namesto njega pa se neposredno uporabljajo zakonske dolo\u010dbe. Zato je klju\u010dno, da se pred pripravami dokumentov preu\u010di ustrezen in posodobljen vzorec pogodba o zaposlitvi, ki je uskladjeni z zadnjim novelami ZDR-1.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3709fc8 e-flex e-con-boxed e-con e-parent\" data-id=\"3709fc8\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7c089cc elementor-widget elementor-widget-heading\" data-id=\"7c089cc\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Kaj mora vsebovati pogodba o zaposlitvi?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-76b8e2a e-flex e-con-boxed e-con e-parent\" data-id=\"76b8e2a\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-58dfe8b elementor-widget elementor-widget-text-editor\" data-id=\"58dfe8b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">ZDR-1 v svojem 31. \u010dlenu izrecno navaja sestavine, ki jih mora vsebovati vsaka zakonita pogodba o zaposlitvi. Pomanjkljivo opredeljene komponente lahko vodijo do globokih pravnih sporov in glob s strani In\u0161pektorata RS za delo.<\/span><\/p><p><span style=\"font-weight: 400;\">Vsaka zakonita pogodba mora vsebovati naslednje elemente:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-197a3b4 elementor-widget elementor-widget-text-editor\" data-id=\"197a3b4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Podatki o pogodbenih strankah<\/span>:<\/b><span style=\"font-weight: 400;\"> Jasna identifikacija delodajalca (naziv, naslov, mati\u010dna in dav\u010dna \u0161tevilka, zastopnik) in delavca (ime, priimek, EM\u0160O, dav\u010dna \u0161tevilka, prebivali\u0161\u010de).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Datum nastopa dela<\/span>:<\/b><span style=\"font-weight: 400;\"> Dan, ko delavec dejansko za\u010dne opravljati svoje naloge.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Naziv delovnega mesta oziroma vrsta dela<\/span>:<\/b><span style=\"font-weight: 400;\"> Kratek opis nalog, ki jih bo delavec opravljal, ter zahtevana stopnja izobrazbe.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Kraj opravljanja dela<\/span>:<\/b><span style=\"font-weight: 400;\"> Natan\u010dna lokacija (ali ve\u010d lokacij), kjer se delo izvaja. \u010ce kraj ni natan\u010dno dolo\u010den, velja, da delavec opravlja delo na sede\u017eu delodajalca.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">\u010cas trajanja delovnega razmerja<\/span>:<\/b><span style=\"font-weight: 400;\"> Podatek o tem, ali gre za pogodbo za nedolo\u010den \u010das ali pa se uporabi pogodba o zaposlitvi za dolo\u010den \u010das.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Dolo\u010dilo o dnevnem ali tedenskem delovnem \u010dasu<\/span>:<\/b><span style=\"font-weight: 400;\"> Opredelitev, ali gre za polni ali kraj\u0161i delovni \u010das ter kako je delovni \u010das razporejen.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Znesek osnovne pla\u010de ter ostala nadomestila<\/span>:<\/b><span style=\"font-weight: 400;\"> Pla\u010da mora biti izra\u017eena v bruto znesku v eurih. Navesti je treba tudi pla\u010dilni dan, dodatke (za delovno dobo, nadure, no\u010dno delo) ter povra\u010dila stro\u0161kov (prevoz, prehrana).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Letni dopust in odpovedni roki<\/span>:<\/b><span style=\"font-weight: 400;\"> Dolo\u010ditev odmere letnega dopusta oziroma na\u010din njegove dolo\u010ditve ter dol\u017eina odpovednih rokov za obe stranki.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b><span style=\"color: #800000;\">Navedba kolektivnih pogodb<\/span>:<\/b><span style=\"font-weight: 400;\"> Opredelitev splo\u0161nih ali pano\u017enih kolektivnih pogodb ter splo\u0161nih aktov delodajalca, ki zavezujejo podjetje in urejajo specifi\u010dne pravice zaposlenih.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-aee7d09 e-flex e-con-boxed e-con e-parent\" data-id=\"aee7d09\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7f6db31 elementor-widget elementor-widget-heading\" data-id=\"7f6db31\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Vrste pogodb o zaposlitvi v slovenski\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-89f9b41 e-flex e-con-boxed e-con e-parent\" data-id=\"89f9b41\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-3fb4218 elementor-widget elementor-widget-text-editor\" data-id=\"3fb4218\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Slovenski pravni red pozna ve\u010d modalitet delovnih razmerij, ki se prilagajajo specifi\u010dnim potrebam podjetij, naravi dela ali dru\u017ebenemu polo\u017eaju delavca. Pogodba o zaposlitvi za dolo\u010den \u010das\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8764908 elementor-widget elementor-widget-text-editor\" data-id=\"8764908\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Slovenska zakonodaja kot pravilo dolo\u010da zaposlitev za nedolo\u010den \u010das, a je v praksi pogodba o zaposlitvi za dolo\u010den \u010das izjemno iskana. Ta oblika pa skriva resne pasti, saj so razlogi za \u010dasovno omejitev strogo zakonsko predpisani. Da ne bi pri\u0161lo do avtomati\u010dne transformacije v trajno zaposlitev, mora podjetje uporabiti brezhibno pripravljen pogodba o zaposlitvi za dolo\u010den \u010das vzorec, ki jasno navaja zakoniti razlog za omejitev in tako podjetje varno obvaruje pred globami in\u0161pekcije. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-575bd96 e-flex e-con-boxed e-con e-parent\" data-id=\"575bd96\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9a2592b elementor-widget elementor-widget-heading\" data-id=\"9a2592b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">2. Pogodba o zaposlitvi s kraj\u0161im delovnim \u010dasom\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-82a433d elementor-widget elementor-widget-text-editor\" data-id=\"82a433d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Ko podjetje nima potrebe po polni zasedenosti, se sklene kraj\u0161i delovni \u010das (manj kot 36 ali 40 ur tedensko). V tem primeru mora biti pogodba o zaposlitvi zastavljena tako, da delavec prejme vse socialne in pogodbene pravice sorazmerno z opravljenimi urami.
