Cu prilejul controlului, au fost identificate zeci sau sute de persoane care lucrau la negru n activiti ocazionale, iar msurile aplicate de autoritile responsabile au generat amenzi usturtoare, decizii de returnare a lucrtorilor i, n anumite cazuri, anchete suplimentare privind metodele de recrutare ale angajatorilor. O asemenea situaie indic faptul c angajatorii care recruteaz personal la negru &#8211; fr contracte i permise emise n mod corect &#8211; se pot confrunta cu sanciuni administrative dure, dar i cu o pierdere a ncrederii partenerilor de afaceri i a clienilor.<\/span><\/p><p><span style=\"font-weight: 400;\">Angajatorii risc\u0103: amenzi mari, suspendarea dreptului de a angaja lucr\u0103tori str\u0103ini, sanc\u021biuni administrative \u0219i poten\u021biale anchete penale \u00een cazuri de fraud\u0103 sau exploatare. Rela\u021biile de munc\u0103 \u00een Rom\u00e2nia sunt guvernate de Legea muncii, care protejeaz\u0103 at\u00e2t angajatorii, c\u00e2t \u0219i angaja\u021bii. <\/span><\/li><li>\u00cenainte de angajare, trebuie s\u0103 redacta\u021bi un contract individual de munc\u0103 pentru fiecare angajat. Redactarea acestui document trebuie s\u0103 fie detaliat\u0103, incluz\u00e2nd titlul postului, atribu\u021biile, salariul, orele de lucru \u0219i perioada de prob\u0103, precum \u0219i altele.<\/li><li>Contractul de munc n Romnia este un angajament formal ntre angajator i angajat prin care acesta din urm i asum responsabilitatea de a respecta drepturile, obligaiile i ndatoririle specificate de angajator n ceea ce privete munca prestat. Contractul garanteaz faptul c ambele pri i vor respecta obligaiile n ceea ce privete fiscalitatea, iar angajatorul va putea deduce impozitele i contribuiile aferente din salariul angajatului<\/span><\/li><li><span style=\"font-weight: 400;\">Evitarea angaj\u0103rii \u00een \u201ezona gri\u201d: <\/span><span style=\"font-weight: 400;\">La uns n Romnia, s munceti fr un contract consumat (adic s munceti la negru sau munca informale) este ilegal i poate avea consecine grave att pentru angajator, ct i pentru angajat. Aceste implica\u021bii sunt reglementate \u00een principal de Codul Muncii din Rom\u00e2nia, \u00een special de Legea nr. 53\/2003 \u0219i modific\u0103rile ulterioare. In aceasta ghidare vom discuta despre diverse contracte de munca, <\/span><span style=\"font-weight: 400;\">incheierea contractului de munca,<\/span> <span style=\"font-weight: 400;\">incetarea contractului de munca <\/span><span style=\"font-weight: 400;\">si suspendarea Acordul Angajatorilor.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c2a8a35 e-flex e-con-boxed e-con e-parent\" data-id=\"c2a8a35\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c3628b3 elementor-widget elementor-widget-text-editor\" data-id=\"c3628b3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>1.Drepturile angaja\u021bilor<\/b><\/p><p><span style=\"font-weight: 400;\">Salariatul care are un contract de munc\u0103 dispune de o serie de drepturi \u015fi obliga\u0163ii prev\u0103zute de lege, printre care:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Concediu \u015fi odihn\u0103: Dreptul la concediu de odihn\u0103 anual pl\u0103tit, concediu medical, concediu de ajustare a situa\u021biei familiale \u0219i s\u0103rb\u0103tori legale.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-discriminare: Fiecare persoan are dreptul s beneficieze de un tratament nediscriminatoriu i de respectarea demnitii sale n cazul n care este victima discriminrii pe criteriu de sex, ras, vrst, handicap, orientare sexual sau orice alt criteriu.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dreptul la plata orelor suplimentare: Salariaii au dreptul s primeasc o remuneraie suplimentar pentru orele lucrate n afara programului de lucru prevzut de contractul lor de munc, n conformitate cu prevederile acestuia.<\/span><\/li><\/ul><p><b>2.Obliga\u021biile Angajatorului<\/b><\/p><p><span style=\"font-weight: 400;\">Angajatorii sunt obliga\u021bi prin lege s\u0103:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Angajatorii trebuie s ofere un mediu de munc sigur i s respecte prevederile legislaiei privind sntatea i securitatea n munc.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Trebuie s se asigure c angajaii primesc salariul la timp i n cuantumul stabilit prin contractul individual de munc.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Angajatorii au obligaia s plteasc contribuiile de asigurri sociale i s nregistreze angajaii la Casa Naional de Pensii.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Drepturile angajatorului n caz de concediere: Dac angajatorul dorete s concedieze un angajat, trebuie s respecte o procedur legal care s cuprind un motiv ntemeiat i o perioad de preaviz.<\/span><\/li><\/ul><p><b>3.Solu\u021bionarea Litigiilor<\/b><\/p><p><span style=\"font-weight: 400;\">Cnd angajatul i angajatorul nu reuesc s se neleag, angajatul poate apela la contractul su de munc pentru a-i rezolva problemele. Indiferent c este vorba de neconcordane ntre salariu, atribuii sau chiar despriri ilegale, contractul este punctul de plecare pentru rezolvarea acestor neajunsuri n concordan cu legislaia aplicabil<\/span><\/p><p><b>4.Modific\u0103ri contractuale<\/b><\/p><p><span style=\"font-weight: 400;\">Orice modificare a termenilor ini\u021biali ai contractului de munc\u0103 trebuie f\u0103cut\u0103 \u00een scris \u0219i convenit\u0103 de comun acord at\u00e2t de angajator, c\u00e2t \u0219i de angajat. Modific\u0103rile neautorizate sau deciziile unilaterale luate de angajator pot duce la contesta\u021bii \u00een justi\u021bie.<\/span><\/p><p><b>5.Sanc\u021biuni pentru nerespectare<\/b><\/p><p><span style=\"font-weight: 400;\">Nerespectarea legisla\u021biei muncii sau neprezentarea unui contract de munc\u0103 formal poate duce la sanc\u021biuni severe pentru angajatori.
