Radi zstite zdravlja, usklajivanja poslovnog i privetnog \u017eivota te postivanja prava radnica, zkonodavac propisuje minimum standard kozih se poslodavci morazu pridrzavati. U ovom tek\u034fstu dajem n\u034fove podat\u034fke za 2026. godinu, koji se oslanjaju\u034f na zak\u034fo\u034fn u \u034fHrvatsko\u034fj i va\u017e\u034fne prakse, s obzirom\u034f na bitnim temama: pravo na godi\u0161nj\u034fi odmoar radno pravo, godi\u0161nji odmoar zakon i i\u034fzra\u010dun godi\u0161njeg odmora po radnom sta\u017eu.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c8aabc4 e-flex e-con-boxed e-con e-parent\" data-id=\"c8aabc4\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-80b181d elementor-widget elementor-widget-heading\" data-id=\"80b181d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">1. Razumijevanje hrvatskog radnog prava za godi\u0161nje odmore\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-fe29c5d e-flex e-con-boxed e-con e-parent\" data-id=\"fe29c5d\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f8f3e29 elementor-widget elementor-widget-text-editor\" data-id=\"f8f3e29\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Zaista, hrvatsko radno zakonodavstvo pru\u017ea jasne odredbe o godi\u0161njem odmoru koje su klju\u010dne za razumijevanje HR stru\u010dnjaka. Prema tim zakonima, minimalni godi\u0161nji odmori postavljeni su na najmanje 20 dana godi\u0161nje, a nijedan zaposlenik ne smije uzeti vi\u0161e od 20 dana godi\u0161nje \u2013 iako stariji i zamjenski zaposlenici mogu po\u010deti s smanjenim radnim vremenom svake godine i stoga im se mo\u017ee odobriti vi\u0161e od 20 dana godi\u0161nje, posebnim odredbama njihovog ugovora ili kolektivnim ugovorima. Neuspjeh u razumijevanju ili pravilnom izvr\u0161avanju nekih od ovih zakona \u0107e privu\u0107i pravne posljedice poput kazni i tu\u017ebi.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-957244c e-flex e-con-boxed e-con e-parent\" data-id=\"957244c\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-1d4fce4 elementor-widget elementor-widget-heading\" data-id=\"1d4fce4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Pravni okvir \u2013 Zakon o radu i drugi propisi<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c0adf1b e-flex e-con-boxed e-con e-parent\" data-id=\"c0adf1b\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9bd4f5e elementor-widget elementor-widget-gimont_elementor_icon_list\" data-id=\"9bd4f5e\" data-element_type=\"widget\" data-widget_type=\"gimont_elementor_icon_list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\n\t\t\t <div class=\"ova-icon-list\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"item item-line \">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<i class=\"fas fa-check\"><\/i>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"info\">\n\t\t\t\t\t\t\t\t<h3 class=\"title\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/h3>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<p class=\"desc\">\n\t\t\t\t\t\t\t\t\t\t\u010clanak 76. utvr\u0111uje da radnik ima pravo na pla\u0107eni godi\u0161nji odmori za svaku kalendarsku godinu.\t\t\t\t\t\t\t\t\t<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"item item-line \">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<i class=\"fas fa-check\"><\/i>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"info\">\n\t\t\t\t\t\t\t\t<h3 class=\"title\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/h3>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<p class=\"desc\">\n\t\t\t\t\t\t\t\t\t\t\u010clanak 77. radnik ima pravo na godi\u0161nji odmoar u traje najmanje \u010detiri tjedna, dok maloljetnici i radnici na nadzornim mjestima sa \u0161tetnim uvjetima rada imaju pravo na pet tjedana.\t\t\t\t\t\t\t\t\t<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"item item-line \">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<i class=\"fas fa-check\"><\/i>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"info\">\n\t\t\t\t\t\t\t\t<h3 class=\"title\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/h3>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<p class=\"desc\">\n\t\t\t\t\t\t\t\t\t\tU kolektivnim ugovorima, pravilnicima ili samom \u034fugovoru o radu mogu\u0107e se dogovoriti du\u017ee trajanje godi\u0161nji  odmoara - ali\u034f nikad manje od\u034f zakonskog\u034f minimuma\n\t\t\t\t\t\t\t\t\t<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"item item-line \">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<i class=\"fas fa-check\"><\/i>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"info\">\n\t\t\t\t\t\t\t\t<h3 class=\"title\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/h3>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<p class=\"desc\">\n\t\t\t\t\t\t\t\t\t\t\u010clanak 77. stavak 3. propisuje da radnik stje\u010de pravo na puni godi\u0161nji odmor nakon \u0161est mjeseci neprekidnog rada kod istog poslodavca. uz napomenu da Prekid izme\u0111u radnih odnosa dulji od osam dana &quot;ponovno pokre\u0107e&quot; taj rok stjecanje prava.\t\t\t\t\t\t\t\t\t<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"item item-line \">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<i class=\"fas fa-check\"><\/i>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"info\">\n\t\t\t\t\t\t\t\t<h3 class=\"title\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/h3>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<p class=\"desc\">\n\t\t\t\t\t\t\t\t\t\t\u010clanak 78. defin\u034fira na\u010din izra\u010duna dijela godi\u0161nj\u034feg odmora za radnike koji nisu ispunili uvjet od \u0161est meseci ili po prestanka radnog odnosa. Prema ovom \u010dlanku, koristi se formula: jedna dwanestina godisnzeg odmora za svaki mjesec rada.\t\t\t\t\t\t\t\t\t<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0365c9c elementor-widget elementor-widget-text-editor\" data-id=\"0365c9c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Ako zaposlenik nije iskoristio godi\u0161nji odmoar po prestanku radnog odnosa, poslodavac mu je du\u017ean isplatiti naknadu za neiskori\u0161teni dio.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-587177d e-flex e-con-boxed e-con e-parent\" data-id=\"587177d\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c7d7366 elementor-widget elementor-widget-heading\" data-id=\"c7d7366\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Europsko pravo i ugovor o radu<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-31ca91b e-flex e-con-boxed e-con e-parent\" data-id=\"31ca91b\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6703b8e elementor-widget elementor-widget-text-editor\" data-id=\"6703b8e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Godi\u0161nji odmor je tako\u0111er pravo zajam\u010deno Uredbom EU-a (Direktiva o radnom vremenu \/ Radno vrijeme i razdoblja odmora). To zna\u010di da pravo na pla\u0107eni godi\u0161nji odmoar ne mo\u017ee biti umanjeno nacionalnim zakonodavstvom ispod minimalnog standarda EU.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41f0d14 elementor-widget elementor-widget-text-editor\" data-id=\"41f0d14\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">U praksi to zna\u010di da, \u010dak i ako nacionalno pravo ima odredbe koje ograni\u010denja pravo u odre\u0111enim slu\u010dajevima, sudska praksa EU zahtijeva da se tuma\u010denje uskladi s ciljem za\u0161tite prava radnika.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-65e40e4 e-flex e-con-boxed e-con vodi\u010dima o radnim odnosima iz 2026. jasno je navedeno da radnik ima pravo na najmanje \u010detiri tjedna pla\u0107enog godi\u0161njeg odmora.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7a56bed e-con-full e-flex e-con e-child\" data-id=\"7a56bed\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2619ca2 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"2619ca2\" godi\u0161nji odmor mo\u017ee se prenijeti u sljede\u0107u godinu, ali ga treba iskoristiti najkasnije do 30. lipnja te na\u010din koji radniku omogu\u0107uju odricanje od prava na godi\u0161nji odmoar \u2013 to pravo je neprenosivo i ne mo\u017ee se otkazati ugovorom.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ff2538d e-con-full e-flex e-con e-child\" data-id=\"ff2538d\"
