Job-related harassment (like unfair treatment, intimidation, and spoken mistreatment) creates major problems for businesses worldwide. Recent laws in Romania show that this problem needs to be tackled to keep the sector running and working well together.
Any conduct based on race, color, sex, religion, age, national origin, disability, or other protected characteristic that creates a hostile, or offensive working environment includes workplace discrimination [discriminarea la locul de munca], workplace harassment [hartuire la locul de munca], and verbal abuse [hartuire verbala]. These behaviors lead to psychological distress and loss of job satisfaction and productivity.
As it often happens victims become stressed, anxious, and depressed and consequently experience increased absenteeism and decreased engagement.
Bullies are bad for trust and cohesion in teams, and bad for productivity.

Recognizing the negative impact of workplace bullying [bullying la locul de munca], Romania has implemented strict legislation to address these issues.
Government Decision No. 970/2023:
From 17 October 2023, this decision requires employers to establish and apply measures to address gender and moral sexual harassment in the workplace. Employers are obliged to establish organizational practices, educate people, and provide guidelines on how and where to file and prosecute harassment incidents.
Implementation Deadline:
These regulations were implemented with the expectation that companies would adhere to them within only six months; the deadline for compliance is 17 April 2024. Failure to the set legal requirements exposes the company to legal implications and harms its reputation.
To foster a safe and productive work environment, employers should:
Develop Comprehensive Policies:
State with a lot of clarity the prohibited conduct such as discrimination at the workplace [discriminarea la locul de munca] the types of harassment [tipuri de hartuire] that are prohibited, and how complainants can receive and through which channel they can follow.
Conduct Regular Training:
Inform workers about the legal provisions made against workplace harassment, concerning their rights as well as the necessity of compliance with a pleasant workplace policy.
Establish Reporting Mechanisms: Organizing assured means that the employees can use to report the incidents without being vulnerable to being dismissed.
Enforce Policies Consistently:
Make certain all complaints are looked into immediately, and where called for, relevant punitive actions are made against the offenders.
Workplace harassment [hartuire la locul de munca] has a legal obligation on Romanian employers to address it and, most importantly, is a significant tool to improve employee well-being and organizational productivity.
